Traffic tickets and municipal court
If you get one or more traffic tickets for a moving violation, New Jersey makes it easy to plead guilty. In many cases you can simply mail in your fine or pay with a credit card on the internet. But then what happens?
The NJ Motor Vehicle Commission (formerly known as the DMV, but now known as the MVC) will assess points against you. Your points are then disclosed to your insurance carrier, which would likely impose surcharges against you for three to five years which could total up to thousands of dollars. In addition, if you get six or more points within three years, the MVC will assess you with a surcharge and if you get 12 or more points, your driver's license will be suspended. So what should you do?
You should call the Law Offices of Richard S. Greenberg. We will submit a not guilty plea on your behalf and appear with you in municipal court. In most cases, we can negotiate with the prosecutor to resolve your case with fewer or perhaps even no points. We may be able to get one or more of your tickets dismissed. Your fine may or may not be higher than had you pled guilty as charged, but even if it is higher, the reduction or elimination of points will save you much more money by avoiding the insurance and MVC surcharges.
If you live out-of-state or have another reason that coming to court would be a hardship, we can probably resolve your case without the need for you to appear in court. And while we usually get excellent results by negotiating with the prosecutor on your behalf, some matters require a trial and in that case we fight hard to win the case.
Matters other than traffic tickets may also be heard in municipal court, such as town ordinance violations. We have expertise to represent you for any municipal court charge against you.

Did you know that more than 98 percent of divorce cases are resolved without a trial? That is because the legal system not only encourages the parties to reach agreements through ongoing negotiation, but also has programs in place to help with the process. Going through a divorce is an emotional time for most people. It is not a time when most people can negotiate objectively. You need an advocate who knows how to represent your interests and who knows what you are legally entitled to.
The Law Offices of Richard S. Greenberg not only does divorces, but we handle all other matters that may be brought to the family court. Is your ex-spouse not complying with the terms of your divorce judgment? We can help you get enforcement. Do you want to pay less alimony or get more alimony? Real estate
The Law Offices of Richard S. Greenberg handles all aspects of real estate transactions and litigation, including:
- Residential purchases
- Residential sales
- Refinancing
- Commercial properties
- Evictions
Residential purchases and sales
Are you buying or selling a house? When you sign a contract prepared by a real estate agent or broker, New Jersey law provides for a three-day attorney review period. During this period, we negotiate amendments to the contract to protect your interests. Or if you have changed your mind about proceeding with the transaction, we can disapprove and terminate the contract for you. If you are buying or selling privately, do not sign any contract until you talk to us, as the law does not give you a three-day attorney review period for privately prepared contracts. Following contract negotiations, we negotiate repairs or credit for repairs after the house is inspected. If you are a purchaser, will we work with your mortgage lender and act as the closing agent for your mortgage loan and title closing. If you are the seller, we prepare your deed and other closing documents and verify that all closing costs are correct.
Refinancing
Many lenders who offer to refinance your mortgage loan may tell you that you do not need an attorney. But who is protecting your interests? Do you think the lender is? No, the lender protects its own interests by using its own attorney and closing agent. To protect your interests, have Law Offices of Richard S. Greenberg represent you and be your closing agent.
Commercial properties
While similar in some ways to residential transactions, there are significant differences that require the expertise of a commercial real estate attorney. Whether you are buying or selling an apartment building, office building, factory, or any other commercial property, the Law Offices of Richard S. Greenberg has the experience to protect your interests and ensure that the transaction is handled properly and completely.
Evictions
New Jersey law is among the most tenant-friendly in the entire United States. In fact, under the so-called Anti-Eviction Act, a residential tenant may not be evicted (even when the lease term ends) without good cause. And there are different statutes and case law that apply to commercial tenant evictions. If you have a tenant that you want to evict, call the Law Offices of Richard S. Greenberg.
Wills and estates
While it may be unsettling to think about, writing a will is one of the most considerate and loving things you can do for your spouse, children, and grandchildren. If you do not have a will, New Jersey intestate law will determine how to distribute your property upon your death. Only by having a will are you and your heirs assured that your property will be distributed as you decide. And because there are estate law and tax consequences to consider, you should have a competent attorney write your will.
